Terms of Service

1. Acceptance of Terms

Welcome to Velora. By downloading, installing, accessing, or using the Velora mobile application ("App") and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use the Service. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

These Terms constitute a legally binding agreement between you and Velora ("we," "us," or "our").

2. Service Description

Velora is an AI-powered companion application that provides users with virtual characters ("AI Characters") capable of engaging in text-based conversations. The Service includes:

• AI-driven conversations with virtual characters;
• AI-generated character images and portraits;
• Subscription-based access to additional characters and features;
• Multi-language support (English and Chinese).

The Service is designed for entertainment and companionship purposes only. AI Characters are not real persons and do not represent real individuals.

3. User Accounts

3.1 Account Registration

To access certain features of the Service, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information;
• Maintain the security of your password and account;
• Notify us immediately of any unauthorized use of your account;
• Be responsible for all activities that occur under your account.

3.2 Eligibility

You must be at least 13 years old (or the minimum age required by applicable law in your jurisdiction) to use the Service. Users between 13 and 18 must have parental or legal guardian consent.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials. Velora is not liable for any loss or damage arising from unauthorized account access.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer the following subscription plans:

• Free Plan: Limited access to 3 characters and 2 photos, with unlimited messages;
• Weekly Plan ($4.99/week): Access to 5 characters and 10 photos;
• Monthly Plan ($14.99/month): Access to 10 characters and 15 photos;
• Quarterly Plan ($29.99/quarter): Unlimited characters and 20 photos.

Prices and features may change at any time. Current pricing is always displayed in the App.

4.2 Billing

Subscriptions are billed through Google Play or Apple App Store, depending on your device. Payment is processed by the respective platform, and their terms apply to all transactions.

4.3 Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the current period ends. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.4 Cancellation and Refunds

You can cancel your subscription at any time through your Google Play or Apple App Store account settings. Cancellation does not entitle you to a refund for the current billing period. Refund requests are handled by Google Play or Apple according to their respective refund policies.

4.5 Free Trial

If we offer a free trial, any unused portion of the trial period will be forfeited when you purchase a subscription.

5. Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights;
• Harass, abuse, threaten, or intimidate any person or AI Character;
• Generate, store, or distribute harmful, offensive, illegal, or explicit content;
• Attempt to extract, reverse-engineer, or replicate the AI models, algorithms, or proprietary technology;
• Use bots, scripts, or automated systems to access the Service;
• Interfere with or disrupt the Service, servers, or networks;
• Share your account credentials or transfer your account to another person;
• Impersonate any person or entity, or falsely represent your affiliation;
• Collect or harvest personal data of other users;
• Use the Service for any commercial purpose without our prior written consent;
• Upload or transmit viruses, malware, or any other malicious code.

Violations may result in immediate account suspension or termination without notice.

6. AI-Generated Content

6.1 Nature of AI Content

All conversations and images generated by AI Characters are produced by artificial intelligence. This content:

• Is fictional and does not represent real persons or events;
• May contain inaccuracies, errors, or nonsensical responses;
• Should not be relied upon for medical, legal, financial, or professional advice;
• May be logged and used to improve the AI models.

6.2 Your Responsibility

You are solely responsible for the content you input and how you interpret AI-generated responses. You acknowledge that AI Characters are not sentient beings and that any emotional attachment is your own experience.

6.3 Content Moderation

We employ safety filters and content moderation to prevent harmful or inappropriate AI outputs. If you encounter inappropriate content, please report it to support@velorai.cc.

7. Intellectual Property

7.1 Our Rights

The Service, including AI Characters, their names, personalities, visual designs, the App interface, logos, and all related content, are the exclusive property of Velora and are protected by intellectual property laws.

7.2 Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

7.3 User Content

You retain ownership of the messages you send. By using the Service, you grant us a worldwide, royalty-free license to use, process, and analyze your messages for the purpose of generating AI responses and improving the Service. This license terminates when your account is deleted.

8. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

• Merchantability, fitness for a particular purpose, and non-infringement;
• That the Service will be uninterrupted, error-free, or secure;
• That AI-generated content is accurate, reliable, or complete;
• That any defects or errors will be corrected.

The Service is intended for entertainment purposes only and should not be used as a substitute for professional advice, medical treatment, or mental health services.

9. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Velora, its officers, directors, employees, or affiliates be liable for:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, data, goodwill, or other intangible losses;
• Damages resulting from your use of or inability to use the Service;
• Damages resulting from actions or inactions of third-party service providers;
• Damages resulting from AI-generated content.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid us in the three (3) months preceding the event giving rise to the liability.

10. Indemnification

You agree to indemnify, defend, and hold harmless Velora, its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service in violation of these Terms;
• Your violation of any applicable law or third-party rights;
• Any content you submit or transmit through the Service.

11. Account Termination

You may delete your account at any time through the App settings or by contacting us at support@velorai.cc.

We reserve the right to suspend or terminate your account and access to the Service at any time, without notice, if:

• You violate these Terms or any applicable law;
• Your actions pose a risk to the Service or other users;
• We are required to do so by law or legal process;
• We discontinue the Service or any part of it.

Upon termination, all licenses granted to you cease immediately. Provisions that by their nature should survive termination shall remain in effect.

12. Changes to Terms

We may modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date;
• Notify you via in-app notification or email at least 30 days before the changes take effect;
• Maintain previous versions upon request.

Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through:

• Good-faith negotiations between the parties;
• If unresolved, binding arbitration conducted individually (not as a class action);
• The prevailing party in any dispute shall be entitled to recover reasonable attorneys' fees.
